Our lawyers have handled a wide range of complex business and liability disputes such as defending tobacco companies, airlines, banks, fortune 500 corporations and oil company franchises. We have defended tobacco companies in the Broin and Engle Class actions and against the State of Florida in its action against the companies for reimbursement of Medicaid and other damages.
We have handled a wide range of business disputes from non-compete litigation to breach of contract matters involving large and small businesses. We have represented health and trucking insurers, a nationwide long term care hospital chain, nationwide advertising companies, the largest book, magazine, and movie publishers and credit card companies in complex litigation.
Mr. Thomas has also represented wineries in litigation with the State of Florida to open up shipping and deliveries via common carrier and in the winery vehicles. Mr. Thomas successfully represented Florida Farm Wineries in Federal Court in striking down the common carrier shipping ban in Florida. This resulted in customers being able to use Fed-Ex and UPS to ship bottles of wine directly to their home from locations throughout the United States. Mr. Thomas also has served on the Board of Directors and General Counsel for two Florida wineries and has advised the wineries on day to day legal issues from premises liability, breach of contract and dealing with business agreements. The legal work enabled the business to significantly grow its bottom line in an additional, new and lucrative area of wine sales.

Mediation is assisted negotiation. In mediation, a trained, neutral third party helps two or more parties negotiate to resolve their dispute. Mediation typically employs a problem-solving approach to address conflict rather than the traditional, adversarial method. Mediators are trained in communication and problem solving skills, which they use to help parties make the best possible decisions about whether to, and how to, resolve their dispute.

Mediation is a voluntary, informal process. Rules of evidence do not apply. Testimony is not taken. Mediation allows parties to control the dispute resolution process, rather than having a judge or some other official control it for them. Mediation is typically faster and more economical than adjudication, and even if mediation does not resolve the dispute, it almost always helps parties clarify and narrow the issues so that adjudication can proceed more rapidly.

How to request mediation.
Since mediation sessions will not be scheduled until both parties consent, your mediation may move faster if the parties discuss and agree to mediation prior to contacting us. In adverse conditions, we will contact each party independently.

Mediation confidentiality.
We abide by and adhere to the confidentiality provisions of the Administrative Dispute Resolution Act of 1996.

Decisions at mediation.
Mediators are not decision-makers or judges and have no personal interest in the substantive outcome of a case. We use our experience in communication and negotiation to help the parties make effective, informed decisions for themselves.
